It took me a while to actually see the deal in the tiny button now. It wasn't that clear before and these products were different prices.

Could it be they are planning an upgrade in the near future? Or, are they needing to get the software into the hands of potential users so they can buy their music due to the economy?

That IS a good deal in that case - for $99 since the original price for that product was $349.

No special pricing as far as I know. I made my $99 purchase back in October. That $349 price in the grid includes some discounted music. But the current full inventory sale is a much better deal. I agree that there are some portions of their web site that are a bit confusing. $99 for the software, $24 for any single track, $34 for any multi-track... you can't miss!

Maestro Music License Agreement

COPYRIGHT MATERIAL
The music in the Muse Music (collectively called the "Music") is proprietary and copyrighted. This copyright is protected under U.S. and International copyright law. Muse Music owns in its entirety and reserves all rights to the Music.


Regarding the Muse music . . . I purchased a set of their tracks and my license uses the term "Maestro" as listed above. The above quote is the first part of my license agreement which was sent along with the tracks. Don't know if that clears or further muddies the music waters!

Here's the email response I received from SmartSound to Dick's original question about the license:

Hello Mark,
These provisions actually should not affect your members use in any way;
please see the explanations below....

#1 Actually the typical slide show, movie, etc is not a "derivative
copyright" as that term is used and defined by the US Copyright Office. It
would be like saying the movies Tropic Thunder or Gone With the Wind are
derived on music they contain, which of course they are not (though this can
happen from timecopyright.

In the case of the "vocal content with words or lyrics" we mean the addition
of a melody line with original lyrics to the SmartSound song itself, we do
not mean the simple fact of people speaking or narrating the movie, while
the music plays - in that latter case the speaking or narration is derived
from the movie or slide show, not from the song so therefore has nothing to
do with this clause. What we are saying here is people can't simply take our
music and add their own singing and lyrics on top of it and then turn around
and sell the new song. Absent using our music as the basis for a new song
with singing and lyrics, this clause has no application to what you are
doing with your slide shows, and your use of our music is fine and easily
within the bounds of our license agreement.

#2 Here we are referring to peer-to-peer file sharing sites known as Torrent
sites. This type of end-user file sharing was made most famous by Napster,
now legitimized, it has spawned an entire industry of copycats doing
essentially the same thing. So here we are referring to the re-distribution
of the music itself, not your video or slide show. I can see from the
inquiry that we should clarify this; but the intent here is to make sure
people are not posting our music, by itself, on these sites. Again, this is
not intended to limit the distribution of your slide show with our music,
which is fine.

Hopefully the explanations above make your members comfortable; the clauses
are really designed to protect us from people literally reusing or
redistributing the music itself, but not to limit your use of your project
in any way, other than defined elsewhere in the license agreement.

At the end of the contest, on April 30th, we will be having a drawing for a copy of Sonic Fire Pro plus 2 CD's. Anyone entering the contest will be eligible for the drawing. So even if you don't win one of the other prizes you could walk away with a very nice prize just for entering.

While most of the entries will use an NLE like Studio or iclone, there's no reason you couldn't use ProShow.

Something to think about if you're interested in SmartSound and can't plunk down the money right now.

Let's just say I think his license language could use some work. His response as applied to a slide show is consistent with what appears to be their intent. But, to me, his words "larger work" would include one where you added lyrics and that's pretty clearly forbidden--whether that makes sense or not is another question. Personally, if I were going to spend money on their product I'd get a written response granting explicit, permission for commercial use in a slide show and keep that on file. I'm no lawyer and don't want to be, but IMHO those words that say they restrict a derivative work leave a big loophole if they had reason to want it.

This stuff should be easy but it's anything but. <sigh>
